TERMS & CONDITIONS

Effective Date: September 27, 2026

Welcome to Divine Detail.

These Terms & Conditions govern your access to and use of the Divine Detail website, products, digital materials, services, and related offerings.

By accessing this website, purchasing a product, scheduling or purchasing a service, or otherwise using our website or offerings, you agree to these Terms & Conditions and any additional policies applicable to the product or service you purchase.

If you do not agree with these Terms, please do not use the website or purchase our products or services.

1. Business Information

This website is operated by Divine Detail.

Divine Detail provides professional automotive appearance services and may also offer professional educational materials, digital products, downloadable resources, business tools, and related products or services.

References to “Divine Detail,” “we,” “us,” or “our” in these Terms refer to Divine Detail and its owner, as applicable.

2. Website Use

You may use this website only for lawful purposes and in accordance with these Terms.

You agree not to:

  • Use the website for fraudulent, unlawful, abusive, or unauthorized purposes;

  • Attempt to interfere with the website's operation or security;

  • Attempt to gain unauthorized access to website systems, customer information, accounts, files, or restricted content;

  • Use automated systems to improperly scrape, copy, reproduce, or harvest substantial website content;

  • Misrepresent your identity or authority;

  • Use the website or its materials in a manner that violates another person's rights; or

  • Use our website, products, or materials in violation of applicable law.

We reserve the right to restrict or terminate access to the website when reasonably necessary to protect the website, our customers, our intellectual property, or our business.

3. Automotive Services

Descriptions of automotive detailing, paint correction, ceramic coatings, overspray removal, contamination removal, odor treatment, and other automotive appearance services are provided for general informational and scheduling purposes.

Actual service requirements may vary based on vehicle size, condition, contamination, paint condition, previous repairs, affected surfaces, customer objectives, and other circumstances discovered during inspection or service.

Unless expressly stated otherwise in writing, website descriptions, starting prices, examples, photographs, estimated correction percentages, or general service descriptions do not guarantee that a particular vehicle will achieve an identical result.

Additional work discovered after inspection or during service may require customer approval and additional charges.

Service-specific estimates, authorizations, warranties, work orders, or other written agreements may contain additional terms applicable to a particular vehicle or service.

4. Digital Products

Divine Detail may sell downloadable professional educational and business materials, including the Professional Overspray Removal Handbook, Complete Overspray Removal Professional Kit, Professional Overspray Removal Business Kit, worksheets, forms, guides, reference materials, calculators, and related resources.

Digital products are delivered electronically. No physical product will be shipped unless the applicable product listing expressly states otherwise.

Purchasers are responsible for reviewing the complete product description and applicable requirements before completing a purchase.

Digital-product purchases are also governed by our Digital Product Purchase, Refund & License Policy, which is incorporated into these Terms by reference.

If a provision of that policy specifically addresses a digital-product matter, that more specific provision will apply to that matter to the extent permitted by law.

5. Digital Product License

Purchase of a Divine Detail digital product provides a limited, non-exclusive, non-transferable license to use the purchased materials as described in the Digital Product Purchase, Refund & License Policy.

Purchase does not transfer copyright, ownership, authorship, trademark rights, or other intellectual-property rights.

A purchasing business may use licensed materials internally with its employees and technicians for work performed on behalf of that purchasing business, subject to the applicable license.

Unless we provide prior written permission, digital products may not be resold, redistributed, publicly uploaded, repackaged, sublicensed, provided to another business, or shared as a substitute for another person or business purchasing its own licensed copy.

6. Educational Materials and Professional Judgment

Our professional training materials are provided for educational and informational purposes.

They are not a substitute for appropriate professional training, experience, manufacturer instructions, product instructions, Safety Data Sheets, workplace safety practices, appropriate PPE, ventilation, or compliance with applicable laws and regulations.

Vehicles, contaminants, paint systems, coatings, films, plastics, trim, glass, previous repairs, products, tools, environmental conditions, and technician skill levels vary.

Users remain responsible for evaluating each situation and determining whether a particular product, process, chemical, tool, repair method, or level of intervention is appropriate.

No educational material can eliminate the need for professional judgment.

7. Pricing Calculator

Any pricing, estimating, costing, margin, or profitability calculator provided by Divine Detail is an informational business tool.

Default assumptions are starting values only.

Users are responsible for reviewing and configuring labor rates, labor costs, material costs, margins, contingencies, taxes, fees, and other assumptions for their own business and market.

No calculator output constitutes a required market price or guarantees job cost, selling price, labor time, customer acceptance, gross profit, gross margin, or profitability.

8. Pricing and Payment

Prices displayed on the website are subject to change without notice.

We reserve the right to correct pricing, product-description, or other inadvertent errors.

Applicable taxes, fees, or other charges may be added during checkout where required.

An order is not considered complete until the applicable payment has been successfully processed or otherwise accepted.

We reserve the right to refuse or cancel an order when reasonably necessary because of suspected fraud, payment problems, obvious pricing errors, unauthorized transactions, legal requirements, or other legitimate business reasons.

If we cancel a successfully paid order without delivering the purchased product or service, the applicable payment will be handled appropriately.

9. Refunds and Digital Purchases

Refund eligibility for downloadable products is governed by the Digital Product Purchase, Refund & License Policy.

Because downloadable intellectual property cannot ordinarily be returned after access has been provided, digital sales are generally final once the purchased files have been made available for download, subject to legitimate delivery problems, duplicate charges, incorrect or corrupted files, material discrepancies, applicable law, and the complete Digital Product Policy.

Refunds, cancellations, deposits, rescheduling, or other terms associated with automotive services may be governed by separate service-specific policies or agreements.

10. Intellectual Property

Unless otherwise identified, the content and original materials made available by Divine Detail—including text, training materials, manuals, worksheets, forms, guides, systems, graphics, logos, photographs, videos, calculators, downloadable files, page designs, and other original materials—are owned by or licensed to Divine Detail and/or David Terral and are protected by applicable intellectual-property laws.

Except for the limited rights expressly granted with a purchased product or service, no ownership rights are transferred to website visitors or customers.

You may not reproduce, publish, distribute, sell, license, repurpose, publicly display, commercially exploit, or create substantially copied competing products from protected Divine Detail materials without permission except where applicable law expressly permits otherwise.

11. Product and Service Results

Examples, case studies, photographs, descriptions, demonstrations, testimonials, or discussions of previous work illustrate particular experiences or results.

They do not guarantee identical outcomes for another customer, vehicle, technician, or business.

Automotive results depend on numerous factors, including existing condition, contamination, material, affected surface, previous repairs, available repair options, products, tools, technician skill, and customer-approved scope.

Business results likewise depend on factors outside our control.

We do not guarantee revenue, profitability, customer acquisition, selling price, insurance approval, warranty determination, or other business outcomes from use of our educational materials or business tools.

12. Third-Party Services and Links

Our website may use or link to third-party services, payment processors, software, websites, platforms, or resources.

Third-party services are governed by their own terms and privacy practices.

A link or integration does not necessarily constitute our endorsement of all content, policies, products, or services provided by the third party.

To the extent permitted by law, Divine Detail is not responsible for third-party websites or services outside our control.

13. Website Availability

We may modify, update, suspend, discontinue, or change portions of the website, products, services, features, pricing, or availability from time to time.

We do not guarantee uninterrupted or error-free website availability.

Temporary outages, maintenance, platform interruptions, payment-provider issues, internet failures, or circumstances outside our reasonable control may affect website access or digital delivery.

When a verified customer experiences a legitimate digital-delivery problem, we will make reasonable efforts to assist with access.

14. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the website and general informational content are provided on an “as available” basis.

Except for warranties or obligations expressly provided in writing or required by applicable law, Divine Detail does not make additional warranties regarding uninterrupted website operation, universal compatibility of educational procedures, guaranteed repair results, or guaranteed business results.

Nothing in these Terms excludes warranties, rights, or remedies that cannot lawfully be excluded.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Divine Detail and its owner will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the use of or inability to use the website or digital educational materials, including loss of profits, revenue, business opportunity, data, or goodwill.

Users of professional educational materials remain responsible for their own technical decisions, product selection, safety procedures, workmanship, vehicle inspection, testing, and repair decisions.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

16. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Divine Detail and its owner from third-party claims, liabilities, losses, damages, and reasonable expenses arising from your unlawful use of the website, unauthorized redistribution or commercial exploitation of our intellectual property, violation of these Terms, or infringement of another person's rights.

This provision does not apply to the extent a claim results from conduct for which applicable law does not permit indemnification.

17. Changes to Products and Educational Materials

We may revise, update, expand, replace, or discontinue products and educational materials.

Unless a product description expressly states otherwise, purchase provides access to the version identified or provided at the time of sale.

A purchase does not automatically include future editions, major revisions, additional products, consulting, video training, new software tools, or future services.

18. Changes to These Terms

We may update these Terms periodically to reflect changes in our products, services, business practices, website, or legal requirements.

The current version and effective date will be posted on this page.

Material changes will apply prospectively to the extent required by applicable law.

Your continued use of the website after updated Terms become effective constitutes acceptance of the updated Terms where permitted by law.

19. Privacy

Use of personal information collected through the website is governed by our Privacy Policy.

Payment information may also be processed by third-party payment providers according to their applicable terms and privacy practices.

20. Governing Law

Except where applicable consumer-protection law requires otherwise, these Terms and disputes arising from them will be governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Any court proceeding arising from these Terms will be brought in a court of competent jurisdiction in Texas, subject to any rights or venue requirements that cannot lawfully be waived.

21. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

22. Entire Agreement and Additional Terms

These Terms, together with the Privacy Policy, Digital Product Purchase, Refund & License Policy, applicable product descriptions, and any service-specific written agreement, constitute the applicable terms governing use of the website and purchases from Divine Detail.

Where a specific written agreement or product-specific policy expressly governs a particular issue, that specific provision will control that issue to the extent permitted by law.
